Terms & Conditions

Version 2026-09-13 · Effective for Biryani & Beyond (India) online ordering, counter orders, loyalty, and digital passport services.

1. Who we are

These Terms govern your use of the Biryani & Beyond website, mobile web experience, counter / walk-in ordering, loyalty points, and Digital Passport (together, the “Services”). By creating an account, placing an order, or using the Services, you agree to these Terms and our Privacy Policy.

We operate as a restaurant / food-service business in India. Prices are in Indian Rupees (INR) and applicable GST is charged as required by law.

2. Eligibility & accounts

  • You must be at least 18 years old, or use the Services under a parent/guardian’s supervision.
  • You must provide accurate name, mobile number, and email. Counter guests may convert a till record into a full account by verifying the same mobile number and adding email + password.
  • You are responsible for keeping your password confidential and for activity under your account.
  • We may suspend or close accounts that are abusive, fraudulent, or violate these Terms.

3. Orders, menu & availability

Menu items, descriptions, photos, and prices are indicative and may change. Portions and availability depend on daily kitchen stock. We may refuse, cancel, or modify an order where ingredients are unavailable, payment fails, or we suspect misuse.

Online orders are typically for restaurant pickup unless we expressly offer delivery for your order. Delivery, if offered, may be limited by area, time, and driver availability.

4. Pricing, taxes & payment

  • Displayed prices are in INR. GST and other statutory charges apply as shown at checkout or on the bill.
  • Payment may be collected online (payment gateway), at the counter (cash / UPI / other accepted modes), or via marketplace platforms (e.g. Zomato / Swiggy) under those platforms’ terms.
  • Promotional codes and loyalty redemptions are subject to stated limits and may be withdrawn.

5. Allergens & food safety

Our kitchen handles common allergens (including dairy, gluten, nuts, eggs, and spices). Cross-contact may occur. If you have allergies or dietary restrictions, tell staff before ordering. We do not guarantee allergen-free preparation unless we expressly confirm in writing for that order.

6. Cancellations, refunds & complaints

Once kitchen preparation has started, cancellation may not be possible. Refunds (full or partial) are assessed case-by-case for quality issues, wrong items, or payment errors, in line with applicable consumer protection law. Contact the restaurant with your order number promptly. Marketplace orders follow the relevant platform’s refund process.

7. Loyalty points & Digital Passport

  • Loyalty points and Passport stamps are promotional benefits, not cash, property, or negotiable instruments. They have no cash surrender value except as we allow for redemption.
  • Stamps may accrue from qualifying paid orders (quantity may count). We may adjust, reverse, or withhold benefits for returns, fraud, or system error.
  • Reward tiers, stamp catalogues, and Passport availability may change or be paused.
  • Benefits are personal to your account / linked phone and are non-transferable unless we say otherwise.

8. Acceptable use

You must not misuse the Services (including scraping, attacking our systems, placing fraudulent orders, or abusing promotions). We may share necessary information with payment partners, platforms, or authorities where required by law.

9. Intellectual property

Branding, menus, recipes presented as our IP, site design, and content belong to Biryani & Beyond or our licensors. You may not copy or exploit them commercially without permission.

10. Liability

To the fullest extent permitted by Indian law, we are not liable for indirect or consequential losses (including lost profits). Our aggregate liability for a claim relating to an order is limited to the amount you paid for that order, except where liability cannot be limited (e.g. proven negligence causing personal injury, or other non-excludable rights under consumer law).

11. Changes

We may update these Terms. The version date above will change when we do. Continued use after an update constitutes acceptance of the revised Terms where permitted by law. Material changes to consent-based processing are described in the Privacy Policy.

12. Governing law

These Terms are governed by the laws of India. Courts at the location of the restaurant’s principal place of business shall have exclusive jurisdiction, subject to mandatory consumer-protection venues.
